These Terms of Service ("Terms") are a binding agreement between you and TC Fusion LLC ("TC Fusion," "we," "us," or "our") governing your use of the Papote mobile application and related services (the "Service"). By downloading or using Papote, you agree to these Terms. If you don't agree, don't use the Service.
You must be at least 13 years old (or 16 where local law requires) to use Papote. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms.
Papote is a French language-learning application. It presents a feed of publicly available short videos in French, played through the official YouTube player, alongside learning tools we create: time-synced captions, translations, contextual word definitions, saved-word lists, and spaced-repetition review.
We may change, add, or remove features; adjust the catalog; and modify or discontinue the Service. We will not knowingly degrade a paid subscription's core function during a period you have paid for without offering a remedy.
All videos in Papote are hosted on YouTube and belong to their respective creators. TC Fusion does not claim ownership of any video content, does not host or re-distribute it, and does not charge for access to it. Video plays through YouTube's official embedded player, and every clip credits and links out to its source channel.
Your use of embedded YouTube playback is also subject to YouTube's Terms of Service. If you are a rights holder and believe content shown in Papote infringes your rights, contact support@tcfusion.dev and we will remove the clip from our catalog promptly.
Transcripts, translations, word definitions, and difficulty levels in Papote are produced substantially by automated systems (speech recognition and machine translation). They are provided for language-learning purposes and will contain errors. Spoken French is particularly hard on them: elision and liaison blur word boundaries, and slang, regional accents, fast speech and idiom all push the error rate up.
Do not rely on Papote for translation of anything important, including legal, medical, financial, safety, or professional matters. Papote is not a certified translation service and makes no guarantee of fluency, exam results, or learning outcomes.
Full access to Papote requires a paid subscription. Current plans and prices are shown in the app before you purchase, and may vary by country.
Papote has no accounts. Your saved words, review schedule, streaks, and history are stored on your device. The Privacy Policy has the detail. Deleting or resetting the app deletes that data permanently, and we cannot restore it, because we never held a copy.
Two ways to keep your own copy exist and both are yours to control. You can turn on iCloud backup, which writes one file into the app's container on your own Apple ID and is off until you switch it on. You can also export your data to a file at any time. We have no access to either one. Your subscription entitlement is separate and can be restored with "Restore purchases," because the app store holds it rather than we do.
You agree not to:
The Papote name, logo, mascot, app design, and the learning layer we create, including our transcripts, translations, glosses, level grading, and review algorithms, are owned by TC Fusion and protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own language learning. Video content remains the property of its creators, as described in Section 3.
Papote's French word definitions are not ours. They come from WikDict by Karl Bartel, built from Wiktionary data via DBnary and licensed CC BY-SA 4.0. The app credits that source wherever definitions appear, as the licence requires. Nothing in this section claims ownership of it, and the licence terms travel with the definitions.
The Service integrates YouTube (video playback), Apple and Google (distribution and payments), RevenueCat (subscription validation), PostHog (analytics), and Sentry (crash reporting). If you turn on the optional backup, it also writes to Apple iCloud under your own Apple ID. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services or content.
You may stop using the Service at any time by deleting the app, and cancel your subscription separately via the app store. We may suspend or terminate your access if you materially breach these Terms, or if required to protect the Service or comply with law. Sections that by their nature should survive termination, including Sections 8, 11, 12, 13, and 15, survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, that any particular video will remain available, or that translations will be accurate. Video availability depends on third parties and can change without notice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TC FUSION WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY US DOLLARS ($50). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold harmless TC Fusion and its members, officers, and agents from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or applicable law.
If you are a consumer resident in the EEA or UK, nothing in these Terms limits your mandatory statutory rights, and you retain the protection of the mandatory laws of your country of residence and the right to bring proceedings in your local courts. You may have a statutory right to withdraw from a digital-content purchase within 14 days. Where the store processes your purchase, exercise that right through Apple or Google.
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. Subject to Section 14, which preserves consumers' rights to their home courts and laws, you agree that any dispute relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Virginia, and you consent to their jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
If you download Papote from the Apple App Store, the following also applies: these Terms are between you and TC Fusion only, not Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the Service, and any claims relating to it (including product liability, legal or regulatory non-conformance, or consumer protection) are our responsibility, not Apple's. Apple is not responsible for addressing any third-party intellectual-property claims relating to the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
We may update these Terms. If a change is material, we will update the date above and notify you in the app. Continuing to use the Service after a change takes effect means you accept the revised Terms.
